NO PURCHASE NECESSARY TO ENTER

Eligibility:  To enter the Drive for Education Sweepstakes (“Sweepstakes”), individuals must satisfy the following requirements as of the end of the Sweepstakes Period (as defined below) (the “Eligibility Requirements”):

  • Be a member of the 2016 graduating class at an accredited Oregon high school;
  • Have an overall grade point average of at least the equivalent of a 3.0 on a 4.0 scale;
  • Be in good standing under their school district’s attendance policy;
  • Complete a minimum of fifteen hours of local community service before May 1, 2016; and
  • Have the written consent of a parent or guardian to enter the Sweepstakes if the Entrant (as defined below) is under 18 years of age.

The following persons are not eligible to enter the Sweepstakes:  Members of the immediate families and/or persons living in the same household as the following individuals:  employees, officers and directors of Kendall Automotive Group Inc. (“Sponsor”) and Sponsor’s affiliated companies, subsidiaries, suppliers, vendors, representatives, distributors, advertising agencies, and promotional suppliers (collectively, “Sponsor Affiliates”).

Sweepstakes Period:  This Sweepstakes begins on February, 7 2016 at 12:01am PST and ends on May 1, 2016 at 11:59 pm PST (“Sweepstakes Period”).

Winners will be chosen through a drawing (as described below) from all eligible and valid entries received during the Sweepstakes Period.

How to Enter:

To Enter the Sweepstakes, qualified individuals (“Entrants”) must fill out the Official Sweepstakes Entry Form and either mail or turn in their application to Kendall Toyota of Bend at 61430 S Hwy 97 Bend, OR 97701, Attn: Tressa Shuttleworth

Entries containing false or fraudulent information will be disqualified.  Limit one (1) entry per person during the Sweepstakes Period.  Duplicate entries for a single individual during the Sweepstakes Period will be disqualified.  Odds of winning depend on number of eligible entries received during the Sweepstakes Period.  Entries remain the property of Sponsor and will not be returned or acknowledged.

All information collected through entry into the Sweepstakes will be used only in accordance with Sponsor’s privacy notice at: http://www.kendallautooregon.com/privacy.htm

Prize:  Ten qualifying Entrants will receive both (a) a $1,000 scholarship, which will be paid directly to the college or university of the winner’s choice for winner’s expenses during the 2016-2017 academic year (“Scholarship Prize”), and (b) a key.  One of the ten keys awarded to the Scholarship Prize winners will start a new 2016 Toyota Corolla L (“Grand Prize”), which has an estimated retail value of $17,230.  Ownership of the Grand Prize will be transferred to the winning Entrant whose key starts the car.  No substitute, transfer, or cash equivalent for either the Scholarship Prize or the Grand Prize is allowed by any winner.  Sponsor, at its sole discretion, may substitute prizes of equal or greater value.

Drawing and Notification:  The Sweepstakes Scholarship Prize winners will be selected in a drawing from all eligible entries received during the Sweepstakes Period.  The results of all drawings, and the decisions of Sponsor and its third party service providers, are final and binding in all respects.  In order to win the Grand Prize or a Scholarship Prize, the Entrant must be present at the drawing held on May 20, 2016 at Kendall Toyota of Bend (61430 S Hwy 97 Bend, OR 97701.)

Consent to Receive Email:  By participating in the Sweepstakes and submitting an entry, Entrants will opt-in to receive email or other communications from Sponsor and the Sponsor Affiliates.  Entrant may subsequently opt-out of the receipt of such email or communications by following the directions in the email or contacting that site.  Entrant’s opt-out status will not affect his or her participation or chances to win in the Sweepstakes.  During the Sweepstakes Period, however, Entrant may nevertheless receive emails which Sponsor deems are related to the Sweepstakes and related programs.

General Conditions:  All Federal, state and local laws and regulations are applicable.  All taxes (including, but not limited to, income taxes), and any and all service charges or fees, including title and registration fees, applicable to the prizes are the sole responsibility of the winners.  The winner of the Grand Prize Toyota Corolla will be responsible for insuring and taking possession of the vehicle.  Each prize winner (or his or her parent or guardian, if the winner is under 18) will be required to execute (and have notarized) an Affidavit of Eligibility, a Liability Release, and a Publicity Release (“Affidavit/Release”).  The Affidavit/Release must be properly executed and returned to and received by Sponsor prior to delivery of the Grand Prize or any Scholarship Prize and in no event more than fourteen (14) days after the drawing.  Each Entrant’s qualifications and compliance with the Eligibility Requirements and these Official Rules may be verified by Sponsor at any time before or after the Sweepstakes Period, including but not limited to verifying the Entrant’s grade point average by requiring provision of school transcripts and verifying community service participation through school records or other documentation provided or released by the Entrant.  Each winner (or his or her parent or guardian, if the winner is under 18) may also be required to complete an IRS Form W-9 before receiving a prize.  Any failure to comply with these Official Rules may result in disqualification and an alternate winner may be chosen.  Return of a prize, any prize notification, or the Affidavit/Release as undeliverable will result in disqualification and an alternate winner will be selected.  The winners’ entry into the Sweepstakes and/or acceptance of the prize constitutes permission for Sponsor and the Sponsor Affiliates to use the winners’ name, address (city and state) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation in Sponsor’s and the Sponsor Affiliates’ newsletters and on the Sponsor’s and the Sponsor Affiliates’ websites, unless prohibited by law.  All Entrants agree to comply with these Official Rules.  Any person attempting to defraud or in any way tamper with this Sweepstakes and any person who does not comply with these Official Rules, will be ineligible for the prize and may be prosecuted to the fullest extent of the law.

THE CIRCUIT COURT OF THE STATE OF OREGON FOR DESCHUTES COUNTY AND/OR THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF OREGON, BEND DIVISION, SHALL HAVE SOLE AND EXCLUSIVE JURISDICTION OF ANY CONTROVERSY REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF OREGON SHALL GOVERN THE SWEEPSTAKES.  EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.

If, for reasons beyond Sponsor’s control, the Sweepstakes is not capable of running as originally planned, Sponsor, at its sole discretion, reserves the right to suspend, cancel or modify the Sweepstakes, without liability.  Sponsor is not responsible for its own, its third party service provider’s, or any Entrant’s computer system, hardware, software or program malfunction or other errors, failures, delayed computer or email transmissions or network connections that are either human or technical in nature.

This Sweepstakes is void where prohibited, restricted, or taxed by law.

Disclaimers:  All Sweepstakes Entrants agree that Sponsor and the Sponsor Affiliates shall not be liable for losses or injuries of any kind resulting from acceptance or use, including misuse, of any prize, or any Entrant’s participation in the Sweepstakes.
